TERMS AND CONDITIONS OF USE

1. INTRODUCTION

These Terms and Conditions ("Terms") govern your use of the mobile application Sabora ("the App"), operated by Flat White Apps SL, a company registered in Spain with its registered office at CALLE DE L'HORT DE LES ANIMES, 22 - LOC B 2 B, PALMA 07007, Spain ("we", "us", or "our").

By downloading, accessing, or using Sabora, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use the App.

2. MEDICAL AND NUTRITIONAL DISCLAIMER

Important: Sabora is an artificial intelligence-based tool designed for meal planning and recipe inspiration. We are not a medical organization or a team of nutritionists.

1. Not Medical Advice: The content provided by Sabora is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

2. Allergies & Dietary Needs: While the App allows you to input preferences, you are solely responsible for verifying the ingredients and suitability of any recipe. We cannot guarantee that suggestions will be free of allergens or suitable for your specific health conditions.

3. Consult a Professional: Always seek the advice of your physician or qualified health provider with any questions you may have regarding a medical condition or dietary change.

3. ACCOUNTS

To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.

You may delete your account at any time directly within the App settings.

4. SUBSCRIPTIONS AND PAYMENTS

Sabora offers a free version and a paid premium subscription ("Sabora Premium" or similar). All payments are processed and managed by Apple.

A. Payment & Billing

• Payment will be charged to your Apple ID account at the confirmation of purchase.

• You authorize Apple to charge your account for all fees payable for your chosen subscription plan.

B. Auto-Renewal

• Automatic Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.

C. Cancellation

• How to Cancel: You can manage and cancel your subscriptions by going to your iPhone Settings > [Your Name] > Subscriptions.

• No Direct Cancellation: We (Flat White Apps SL) cannot cancel your subscription for you, as we do not have access to your Apple billing data. Uninstalling the app does not cancel your subscription.

D. Refunds

• All refund requests must be handled directly by Apple. We do not have the ability to issue refunds for purchases made through the App Store.

E. Price Changes

• We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time. Any price changes will take effect following notice to you, usually via an App Store notification or email.

5. LICENSE AND INTELLECTUAL PROPERTY

Subject to your compliance with these Terms, Flat White Apps SL grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use.

• Ownership: The App, including its text, graphics, images, code, and AI models, is the property of Flat White Apps SL and is protected by copyright and intellectual property laws.

• Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

6. USER CONDUCT

You agree not to use the App:

• In any way that violates any applicable national or international law.

• To transmit any unsolicited advertising or promotional material.

• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law (including Spanish Consumer Law):

1. "As Is" Basis: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties regarding the accuracy or completeness of the recipes or nutritional data provided.

2. No Liability: Flat White Apps SL and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

8. THIRD-PARTY LINKS

The App may contain links to third-party websites or services (e.g., grocery delivery partners) that are not owned or controlled by Flat White Apps SL. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

9. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Palma de Mallorca, Spain, unless applicable consumer law requires otherwise.

10. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice via the App or website prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
